Terms of use

These terms are between you and Kindgi Inc., a Delaware corporation (“Kindgi”, “we”). They cover our three sites:

• kindgi.com, our website;
• docs.kindgi.com, our documentation;
• access.kindgi.com, where you sign in to get a pull credential for the Kindgi runtime image and a non-production license key.

Part A applies to all three. Part B adds the rules for access.kindgi.com. By using our sites, you agree to these terms. By signing in at access.kindgi.com, you agree to Part B too. If you sign in with your work email, you also agree on behalf of your organization, and you confirm you’re allowed to.

The Kindgi software has its own licenses, and they still apply. The SDKs and the CLI are Apache-2.0. The runtime is under the Business Source License 1.1 (see Licensing).

Part A: our sites

1. Using our sites

Our sites are free to read. Don’t interfere with them, overload them, or probe them for weaknesses without our written permission. Found a security problem? Tell us at contact@kindgi.com.

2. The documentation

The documentation’s source is in our public kindgi-sdk repository, under the Apache License 2.0. You can copy and adapt it under that license.

The documentation explains how the software works, version by version. It can be incomplete or out of date: check the version you run. It isn’t professional advice.

3. Our content and name

Except where a license says otherwise, as for the documentation above, the content of our sites belongs to Kindgi. The Kindgi name and logo are our trademarks. The Apache License doesn’t cover them (its section 6).

4. Other services

Our sites link to other services: GitHub (sign-in, the repository and its issues), cal.com (booking a call) and Red Hat Quay.io (the runtime image). Their own terms apply when you use them.

5. Your information

Privacy at Kindgi says what we collect on our sites, why, and what you can ask us to do with it.

Part B: access.kindgi.com

6. What you get

• A pull credential, personal to you, to download the Kindgi runtime image.
• A non-production license key, to run the runtime outside development mode. It lasts 45 days and is renewed when you sign in within 30 days of its expiry. With a personal email address, the key is yours. With a company email address, it’s your company’s key, shared with everyone who signs in from that company’s domain.

The service and both credentials are free.

7. Who can sign in

You need a GitHub account at least 30 days old, with a verified primary email address. Use one GitHub account, your own, and don’t sign up on someone else’s behalf except your own organization’s. You must be at least 16, and old enough to agree to these terms where you live.

8. Non-production use only

The non-production key, and the runtime’s free use, cover these environments, including deployed ones:

• development;
• continuous integration;
• testing;
• staging.

They must serve no end users or customers, and process no live business data.

Production use needs a commercial license from Kindgi. Production means using the runtime to serve end users or customers, or to process live business data as part of an organization’s operations. That includes internal systems the organization’s own employees use. Write to contact@kindgi.com.

9. Keep your credentials to yourself

• Don’t share your pull credential, or publish it anywhere (a public repository, a log, a chat).
• Share a company key only within your company.
• If a credential leaks, regenerate your pull token on the site and tell us at contact@kindgi.com.

10. Acceptable use

Don’t:

• use the service or the credentials against the law;
• try to get around the license key check, eligibility rules or rate limits, or create accounts to get more credentials;
• interfere with the service, probe it for weaknesses without our written permission, or overload it;
• use a key for production, or give a key to someone it wasn’t issued to.

11. Suspension and ending

• We can suspend or revoke your access or a key at any time: for example, if you break these terms, to protect the service or other users, or if we end the program. Where we reasonably can, we’ll tell you first.
• You can stop at any time, and ask us to delete your account (see the Privacy page).
• A revoked key stops being renewed. Because the runtime checks keys offline, a key you hold keeps verifying until its expiry date. Don’t use it after we’ve told you it’s revoked.

Sections 8, 10 and 13 to 16 continue to apply after your access ends.

12. Changes to the service

The program is free. We may change it or end it, including what qualifies and how long keys last.

Part C: for all three sites

13. No warranty

Our sites, the documentation, the service, the credentials and the runtime you run with them are provided “as is” and “as available”, without warranties of any kind, express or implied, to the extent the law allows. That includes merchantability, fitness for a particular purpose and non-infringement. This is pre-release software, and it can change or stop working.

14. Limitation of liability

To the extent the law allows:

• Kindgi isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, arising from our sites, the documentation, the service or these terms;
• Kindgi’s total liability for any claim about them is limited to USD 100.

Some places don’t allow these limits, so they may not all apply to you.

15. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute about them goes to the state or federal courts in Delaware, and both sides agree to their jurisdiction. This doesn’t take away any protection you have under the mandatory laws of the place where you live.

16. Changes to these terms

When we change these terms, we update their date at the top.

• A material change: we’ll email people who have an access.kindgi.com account at least 30 days before it applies to them. Signing in after that means you accept the new terms.
• Using our sites after a change means you accept the new terms.
